Regular Meeting of the Ohio Town Board was held on Tuesday, May 14, 2013 at 7:00 PM at the Recreation Building
The following Officials were present:
Supervisor: Scott Bagetis
Town Clerk: Sandra Gates
Councilmembers: George Lawson, Gordon Roark, Ed Luther and Michelle Barrows
Highway Superintendent: James Nightingale
Also present: Secretary Pat Reuter, Codes Enforcement Officer Greene, Justice Greene and several town residents
The meeting was called to order by Supervisor Bagetis at 7:00 PM
The Pledge of Alligance was said by all.
Minutes of the regular meeting held on April 9, 2013 were read and approved on motion by Councilmember Barrows, second by Councilmember Lawson. Minutes of the Workshop Meeting held on April 15, 2013 were read and approved on motion by Councilmember Roark, second by Councilmember Barrows. So carried.
Supervisor’s Report and Abstract #5 General Fund #96 through #119 in the amount of $39,139.74 and Highway Fund #97 through #125 totaling $72,868.74 was approved on motion by Councilmember Lawson, second by Councilmember Roark. So carried.
TOWN PROPERTY AND RESOURCE POLICY: Supervisor Bagetis read the following Town of Ohio Town Property and Resource Use Policy:
It is the intent of the Town Board that Town Property and Resources be appropriately utilized and not abused by any Board member, Officers or Employees.
Therefore, no Town Board Member, Officers or Employees may use town owned resources (i.e. oil/gas for personal vehicles or home heating.) for personal purposes or profit or to benefit any person. Use of these resources is restricted to the conduct of official business, for the benefit of all residents and to further an authorized public purpose.
If emergency circumstances do not allow for a delay until the full Board can convene, the Town Supervisor or the Highway Superintendent must obtain a verbal approval from at least three members of the Board prior to authorizing the usage.
Councilmember Barrows made a motion to adopt the policy, second by Councilmember Luther. So carried
CODES: Monthly report given to Supervisor.

HIGHWAY: Nightingale presented the Highway Agreement for expenditure of Highway Funds. Councilmember Barrows made a motion to approve the Highway Agreement, second by Councilmember Lawson. So carried.
EQUIPMENT: He would like to put the 2007 Chevrolet pickup out for bids, he will list it on Craig’s list and advertise in the Observer Dispatch and the Evening Telegram for bids to be opened at the next board meeting.
TRUCK #7 2006 Freightliner, he gave estimates to board members from Express Auto for sand blasting and painting of the frame at a cost of $3,069.40 and sand blasting and painting of body at a cost of $2,069.40, Councilmember Lawson made a motion to approve the estimates, second by Councilmember Barrows. Nightingale stated the sand blasting and painting will be done during the July shut down.
FERRIS TRACTOR: Nightingale gave board members estimates for a new Ferris Tractor from Clinton Tractor at New York State Pricing. He stated he needs the tractor for mowing of the recreation field and he will purchase a bagger for the tractor at a later date to save on manpower. He would like the monies to come out of the General Fund for the purchase.
Councilmember Lawson made a motion to approve the purchase of the Ferris IS 3100z Zero turn 36 gross HP Vanguard Big Block with 61” deck for $9,320.00 with an additional $165.00 for shipping, from the General Fund, Fund Balance as a non budgeted item, second by Councilmember Roark. So carried.
Nightingale stated he has invited author Roy E. Reehil to speak at the Recreation Hall on June 13 at 7:00 PM to discuss his book Adirondack Adventures.
RECREATION: Supervisor Bagetis stated Amie Robinson has been hired as the Program Director as long as all paperwork passes through the New York State Health Department. Board members discussed the program and recommended that at this time the program be open to Town of Ohio residents only.
OHIO DAYS: There will be an information Meeting held on May 28 at 6:30 PM.
ALCOHOL PERMISSION: Councilmember Roark made a motion to approve alcohol at the recreation hall on June1, 2013 and July 6, 2013, second by Councilmember Barrows.
NOBLEBORO OVERLOOK: Supervisor Bagetis will meet with Ed Franz from New York State Department of Transportation to discuss the adoption of the Overlook.
GRANTS: Supervisor Bagetis stated there are some grants available for Economic Development, but he feels that the grants available at this time are not appropriate for the Town; he will continue to look for grants.

RECREATION FLOORING: Supervisor Bagetis has an estimate from Oneida Flooring for prep work and vinyl tiles at a cost of $6,000.00. He will get estimates for painting the floor; he will also ask the Town of Norway who did their floors.
Councilmember Barrows made a motion to go into executive session at 8:45 PM to discuss a possible legal issue, second by Councilmember Roark. So carried.
Councilmember Lawson made a motion to return to regular session at 9:00 PM, second by Councilmember Luther. So carried.
Appointments for the Town Attorney and Health Officer were tabled at this time.
Councilmember Lawson made a motion to adjourn at 9:05 PM, second by
Councilmember Luther. So carried.
