Regular Meeting of the Ohio Town Board was held on Tuesday, July 9, 2013 at 7:00 PM at the Recreation Building
The following Officials were present:
Supervisor: Scott Bagetis
Town Clerk: Sandra Gates
Councilmembers: George Lawson, Gordon Roark, Ed Luther and Michelle Barrows
Highway Superintendent: James Nightingale
Also present: Secretary Pat Reuter, Book keeper Ruth Roark, Codes Enforcement Officer Greene, Tax Collector Carol Smith, Danny King, Jason Maher and Richard Wright
The meeting was called to order by Supervisor Bagetis at 7:00 PM.
The Pledge of Allegiance was said by all.
Minutes of the Regular Meeting held on June 11, 2013 were read and approved on motion by Councilmember Lawson, second by Councilmember Barrows. So carried.
Minutes of the Workshop Meeting held on July 2, 2013 were read and approved on motion by Councilmember Roark, second by Councilmember Luther. So carried.
Supervisor’s Report and Abstract #7 General Fund #149 through #171 in the amount of $26,115.59 and Highway Fund #165 through #190 totaling $59,167.23 was approved on motion by Councilmember Lawson, second by Councilmember Roark. So carried.
CODES: Monthly report given to Supervisor.
HIGHWAY: Nightingale would like the Supervisor to look at the general fund, Superintendent of Highway account A5010.2 equipment as it is in the red and he is unsure why.
Truck #13, every time the PTO is engaged the truck has to be shut down, a hydraulic PTO will be installed at an approximate cost of $1800.00 to $2,200.00.
Truck #7 has been painted.
Superduty needs to be repainted, which is covered under the warranty.
Roller will be rented until the end of July.
The work at North Lake has been started.
We helped the Town of Fairfield during the flooding.
Gray Wilmurt Road Intersection is eroding, Nightingale will contact the County.
Due to flooding Teacup Street and the Snyder Road had washouts.
Councilmember Luther asked Nightingale about the purchase of four tires for the pickup. Nightingale stated instead of having to change winter and summer tires he purchased another set and will save money from changing and balancing twice.

SUMMER PROGRAM: Supervisor Bagetis stated approximately 30 children are attending per day and a few more have signed up today.
CORRESPONDENCE: Alcohol permission at the Recreation Hall on July 13 and August 4, 2013 was approved on motion by Councilmember Barrows, second by Councilmember Lawson. So carried.
NYSDEC: A mining permit has been issued to Brett Weakly.
USDA GRANT: USDA Rural Development Community Facility Direct loan and Grant Program the grants range from $10,000.00 to $30,000.00. Supervisor Bagetis will look into applying.
ORRC: Supervisor Bagetis has received a check from the Ohio Ridge Riders Club for the purchase of property to enlarge the recreation field, he will contact an attorney to have the transfer filed.
He will contact ORRC to discuss the rental of the recreation facilities for the weekend of Snow Bash.
Board members discussed the rental and Councilmember Roark made a motion to get a written agreement and no rental fee, second by Councilmember Barrows.
WILMERT CEMETARY: Supervisor Bagetis stated he has talked to the Association of Towns Attorney concerning the cemetery. The cemetery is privately owned, the Town will continue to mow it, but the Town can not repair the driveway into the cemetery.
WORKER’S COMPENSATION RECCOMENDATIONS: The Supervisor has installed curtains and has tie wrapped the chairs together in the Court Room as suggested by the Worker’s Compensation inspector. Areas around the eyewash station and electrical panel in the garage have been slated to be marked as clear areas, as per the inspector’s recommendation, and will be accomplished as time allows. Estimates from the manufacturer or dealer on the availability and cost to install a panic bar on the chipper will be acquired. The Supervisor has responded to the Worker’s Compensation Alliance questionnaire regarding the issues mentioned above within the allotted 60 day time frame.
STANDARD WORK DAY RESOLUTION: Councilmember Lawson made a motion to approve the standard workday resolution,
Be It Resolved, that the Town of Ohio location Code 30650 hereby establishes the following as standard work days for elected and appointed officials and will report the following days worked to the New York State and local Employees’

Retirement System based on the time keeping system records or the record of activities maintained and submitted by these officials to the clerk of this body, second by Councilmember Roark. So carried.
ATV’S: Richard Wright stated they are working on the trail system and will have
more information at the next meeting.
Councilmember Lawson made a motion to adjourn at 8:05 PM, second by Councilmember Luther. So carried.
