Regular Meeting of the Ohio Town Board was held on Tuesday, April 14, 2015 at 7:05 PM at the Recreation Building
The following Officials were present:
Supervisor: Scott Bagetis
Town Clerk: Sandra Gates
Councilmembers: George Lawson, Ed Luther, and Gordon Roark Absent: Jason Maher
Highway Superintendent: Jim Nightingale
Also present: Secretary Pat Reuter, Bookkeeper Ruth Roark, Dog Control Officer Gary Phillips and several Town residents
The meeting was called to order by Supervisor Bagetis at 7:05 PM.
Minutes of the Regular Meeting held on March 10, 2015 were read and approved on motion by Councilmember Lawson, second by Councilmember Roark. So carried.
Minutes of the Workshop Meeting held on March 16, 2015 were read and approved on motion by Councilmember Luther, second by Councilmember Roark. So carried.
Supervisor’s Report and Abstract #4 General Fund #76 through #102 totaling $28,826.68 and Highway Fund #88 through #123 totaling$74,775.25 were approved on motion by Councilmember Luther, second by Councilmember Roark. So carried.
Councilmember Lawson made a motion to adopt Local Law #1-2015 Change the Grievance Day for Assessments, second by Councilmember Roark.
LOCAL LAW #1-2015: Local Law to Change the Grievance Day for Assessments
SECTION I:Short Title and Applicability
This local las shall be known and may be cited as “A Local Law To Change The Grievance Day for Assessments.”
SECTION II: Purpose
It is the purpose of this Local Law to change the Grievance Day for the Town of Ohio from the fourth Tuesday in May to the second Wednesday following the fourth Tuesday in May. The Town of Ohio presently employs an Assessor who is at the same time employed by another assessing unit with the same Grievance Day as the Town of Ohio. Therefore, pursuant to the N.Y.RPT. Law§512(1-a), the Town of Ohio desires to establish a date for Grievance Day other than that for in N.Y.RPT. Law§512(1)
SECTION III. Authority
This Local Law is adopted pursuant to Section 512 of the New York State Real Property Tax Law.
SECTION IV. Grievance Day Established
The 2015 Grievance Day shall be held on the second Wednesday following the fourth Tuesday in May and each Grievance Day thereafter shall be held on the second Wednesday

following the fourth Tuesday in May until this Local Law is rescinded or superseded by subsequent Local Law.
SECTION V: Inconsistency
All other Laws and Ordinances of the Town of Ohio that are inconsistent with the provisions of this Local Law are hereby repealed; provided, however, that such repeal shall only be to the extent of such inconsistency and in all other respects this Local Law shall be in addition to such other Local Laws or Ordinances regulating and governing the subject matter covered by this Local Law.
SECTION VI. Effective Date
This Local Law shall take effect immediately upon its filing with the Secretary of State of the State of New York.
Roll call vote to adopt Local Law #1-2015 Change of Grievance Day for Assessments: Councilmember Lawson-aye, Councilmember Luther-aye, Councilmember Roark-aye, Councilmember Maher-absent and Supervsor Bagetis-aye. So carried.
ATV LOCAL LAW #2-2015: There will be a Workshop Meeting on Thursday April 16, 2015 at the Town Office at 7:00 PM. Supervisor Bagetis stated he has finished all the site surveys.
BUDGET: There will be a financial planning meeting held on Thursday April 23, 2015 at the Town Office at 6:00 PM.
BUILDING IMPROVEMENTS: Supervisor Bagetis stated the new wood floor has been installed at the Town Office.
CODES: Monthly report given to Supervisor.
HIGHWAY: Superintendent Nightingale requested a moment of Silence for William Hart.
Councilmember Roark made a motion to appoint William Taylor as Deputy Highway Superintendent, second by Lawson.
New York State CHIPS monies has been approved in the amount of $175,450.25.
Nightingale stated the Freightliner and the Sterling dump boxes have started to deteriate and they need to be replaced, he would like to take the box from truck #7 and use it on truck#15 and purchase a new one for truck #7.
Nightingale gave board members the following estimates:
Tracey Road Equipment Everest Side Dump Spreader Body and a roll rite tarp system $42,244.00
Wayne’s Welding Inc Tenco Combination Dump Body and an aero tarp system $43,307.00.
Nightingale stated possibly 50% of the cost could come out of CHIPS monies. He will check.
He would like the Everest Body as they tend to last longer.

He will get road millings from Woodgate and have them trucked to North Lake. He will possibly pave Reese Road and finish Figert Road with CHIPS monies.
TRASH DAY: Trash day will be May 9, 2015 from 8:00 AM to 12:00 PM. Nightingale stated he would like the gates closed at night as he has had an issue with dumping. He would like to upgrade the fencing between the salt shed and tree line and or possibly have two dumpsters that can be locked. Councilmember Luther would like notice posted in Gray for Trash Day.
RECREATION: Supervisor Bagetis will post the openings for summer employment within the next week.
APA Major Project #2015-50: Application for a project located on or near Fisher Road for four campsites. Kevin Jones addressed the board with his concerns regarding the campsites. He is concerned about the environmental impacts, road traffic, loss of property value, noise and having a commercial business in a residental area. He will keep the board updated as to the APA progress.
RECORDS MANAGEMENT: All the records are at the vendors to be scanned.
BALL FIELD: Little League will start using the field on May 2.
TOWN SIGN: The post needs to be replaced on the Town Sign on State Route 8.
James Davis addressed the board and requested the use of the field for a Benefit for Children with Cancer Annual Tractor Pull and a Chinese Auction. All proceeds will go to a child and his family that has cancer. His tentative date is July 11, 2015, he will check with Pat Reuter if that date is available.
Councilmember Lawson made a motion to adjourn at 8:05 PM, second by Councilmember Luther. So carried.
