Regular Meeting of the Ohio Town Board was held on Tuesday, January 12, 2016 at 7:00 PM at the Recreation Building

 

The following Officials were present:

Supervisor: Scott Bagetis

Town Clerk: Sandra Gates

Council member’s: Ed Luther, Gordon Roark and David Mower Absent George Lawson

Highway Superintendent: James Nightingale

Also present: Book Keeper Ruth Roark, Secretary Pat Reuter, Codes Enforcement Officer Jeff Greene, Justice Kim Tranter, Tax Collector Carol Smith, Dog Control Officer Gary Phillips, and several Town residents

 

The meeting was called to order by Supervisor Bagetis at 7:13 PM.

 

Minutes of the Regular Meeting held on December 8, 2015 were read, corrected and approved on motion by Council member Roark, second by Council member Luther. Minutes of the Workshop Meeting held on December 14, 2015 were read and approved on motion by Council member Roark, second by Council member Mower. So Carried.

 Supervisor’s Report and Abstract #1 General Fund #1 through #30 totaling $23,237.04 and Highway Fund #1 through #22 totaling$31,003.85 were approved on motion by Council member Roark, second by Council member Luther. So carried.

Supervisor Bagetis stated we are under budget for 2015.

Supervisor Bagetis stated the .6% increase on the tax bills is tax levies not an increase in tax rate. The tax rate increased by .09%.

BUDGET TRANSFERS: Council member Roark made a motion to approve the following General Transfers, second by Council member Mower. So carried.

HIGHWAY SHARED SERVICES AGREEMENT between NYSDOT and the TOWN of OHIO:

 

THIS AGREEMENT, dated January 12, 2016, is between the People of the State of New York, hereinafter referred to as “State” or “NYSDOT” and the Town of Ohio, hereinafter referred to as “Municipality.” Pursuant to Section 99-r of the General Municipal Law, the State and the Municipality wish to share services, exchange or lend materials or equipment which shall promote and assist the maintenance of State and Municipal roads and highways and provide a cost savings by maximizing the effective utilization of both parties’ resources. The State and the Municipality agree to share services as follows:

  1. Description and cost of Services, Materials or Equipment to be shared: Provide details of the services, materials or equipment to be shared in the attached standard Schedule A. The total amount of the agreement shall not exceed ten thousand dollars ($10,000.00). If applicable, indicate that the return exchange will be determined at a later date.

  2. The Provider’s employees shall remain under full supervision and control of the Provider. The parties shall remain fully responsible for their own employees for all matters, including but not limited to, salary, insurance, benefits and Workers Compensation.

  3. If the borrowed machinery or equipment is damaged or otherwise needs repairs arising out of or in connection with the Recipient’ use, the Recipient shall be responsible for such repairs.

  4. The Municipality agrees to indemnify the State for any and all claims arising out of the Municipality’s acts or omissions under this Agreement.

  5. The term of this Agreement shall be for one (1) year. The parties will endeavor to provide no less than thirty (30) days’ notice if its intent to extend the Agreement. Either party may revoke this Agreement by providing sixty (60) days written notice of such revocation. Upon revocation, any outstanding obligation of the parties must be satisfied within thirty (30) days of the date of such revocation.

 

 Council member Luther made a motion to approve the above shared services agreement, second by Council member Roark.

 Roll call vote as follows: Council member’s Lawson-Absent, Luther-aye, Roark-aye, Mower-aye and Supervisor Bagetis-aye. So carried.

 HIGHWAY: Nightingale gave board members copies of a service warranty for the John Deere Loader from Five Star Equipment. Board members discussed the warranty options and would like Nightingale to discuss it with the Salesman.

NORTH LAKE LIGHTING: Supervisor Bagetis stated LED light fixtures are too costly. He will retro fit the fixtures using eight foot section of T8 and change the electronic ballast at an approximate cost of $15.00 and bulbs approximately $9.00, there are 18 fixtures. Nightingale will wash down the walls to help improve the light reflection in the spring.

SKATING RINK: It has a leak.

BALL PARK: The gates need to be locked.

SPRING SIGN: Supervisor Bagetis is still researching the wording the sign needs.

ATV LITIGATION: Supervisor Bagetis reported the litigation is finished.

OHIO DAYS: Council member Roark would like to have a meeting to discuss the Ohio Days.

Council member Roark made a motion to adjourn at 8:25 PM, second by Council member Mower. So carried.
