Regular Meeting of the Ohio Town Board was held on Tuesday, November13, 2012 at 7:00 PM at the Recreation Building

The following Officials were present:

Supervisor: Scott Bagetis

Town Clerk: Sandra Gates

Councilmembers: George Lawson, Gordon Roark, Ed Luther and Michelle Barrows

Highway Superintendent: James Nightingale

Also present: Secretary Pat Reuter, Bookkeeper Ruth Roark, Codes Enforcement Officer Jeff Greene, Assessors David Rhea and Berdet Barrows and several town residents

The meeting was called to order by Supervisor Bagetis at 7:00 PM.

 

The Pledge of Alligance was said by all.

 

Minutes of the Regular Meeting held on October 9 11, 2012 were read and approved on motion by Councilmember Lawson, second by Councilmember Barrows. So carried.

Minutes of the Budget Workshop held on October 15, 2012 were read and approved by Councilmember Roark, second by Councilmember Luther. So carried.

Minutes of the Budget Workshop held on October 31, 2012 were read and approved by Councilmember Barrow, second by Councilmember Roark. So carried.

Minutes of the Public Hearing for the 2013 Budget held on November 7, 2012 were read and approved by Councilmember Barrows, second by Councilmember Luther. So carried.

 

Supervisor’s Report will be available as soon as possible. Abstract #11 General Fund #229 through #257 in the amount of $36,454.80 and Highway Fund #243 through #281 totaling $163,130.71 were approved on motion by Councilmember Lawson, second by Councilmember Luther. So carried.

 

CODES: Monthly Report given to Supervisor.

 

HIGHWAY: Nightingale read a letter to the board regarding his wage increase, he asked for a cost of living raise and did not receive it, he stated he was elected by the people and that he takes pride in the job he does for the Town, he would like the board to state why he did not get the cost of living raise.

Councilmember Barrows stated he performs his job duties very good, but that the cost of health insurance was why she did not give him a bigger wage increase.

Councilmember Lawson stated he does a great job.

Councilmember Luther stated this is his first year in office and next year he will look at where he pinches pennies.

Nightingale stated winter is here, plows are on the trucks.

The Fitness trail is approximately 90% finished.

Councilmember Roark made a motion to approve the bid from T D Construction Ryan P. Tiede of $12,000.00, second by Councilmember Lawson. So carried.

Nightingale will contact him to let him know.

 

FITNESS TRAIL: Supervisor Bagetis stated it is usable and in the spring touch ups will be done. He has applied for an additional $5,000.00 grant from Herkimer County Health Net. It can be used for the ice skating rink, signs and for the playground.

Jeff Greene will contact the Snowmobile Club to ask them to groom the fitness trail this winter, he will get back to us.

 

CORRESPONDENCE: Supervisor Bagetis attended a Adirondack Review Meeting. The discussion included DEC purchase of land in the Adirondack Park, and the effect that is having to current economics and future land use opportunities. Fred Reuter brought up the disrepair of the Nobleboro Overlook. One of the Review Board members stated that he would personally contact the NYSDOT and DEC to discuss the condition of the Overlook. A subsequent email received by the Town suggests that both the NYSDOT and DEC would be in favor of the community members of the Town of Ohio adopting the Overlook.

 

INSURANCE: Supervisor Bagetis has received quotes for medical, workers compensation and liability; he is still comparing policies and prices.

UNIFIED COURT NOTICE: Justices have been notified by the State Comptrollers office that beginning January 2013 Justice court reports Invoice Billing Program( IBP) will be implemented.

JUSTICE AUDIT: Councilmember Luther made a motion to approve the Justice Audit for 2011 done by Supervisor Bagetis, second by Councilmember Roark. So carried.

 

ASSESSORS: Assessor David Rhea will purchase a new printer for the Assessors as there is money in the budget for it. He stated that at the last meeting he mentioned contacting Poland Central School to help recoup some of the court cost for property evaluation. Supervisor Bagetis stated he has not at this time.

 

Assessor read a letter from Jonathan Lack from New York State Office of Real Property Tax Services stating that for successfully completing a reassessment project you have been issued and EXCELLENCE IN EQUITY AWARD.

Nightingale stated the fuel bids should be rebid as they are not uniform.

Councilmember Roark made a motion to rebid for fuel using a uniform bid package, to be opened at the December board meeting, second by Councilmember Lawson.

 

WEBSITE: Supervisor Bagetis stated it should be up and running in December.

 

Nightingale suggested anyone living on State Route 8, which has the rumble strips near them, should send a petition to the New York State Department of Transportation complaining of the noise.

Councilmember Barrows made a motion to go to executive session to discuss litigation at 8:25 PM, second by Councilmember Lawson.

Councilmember Barrows made a motion to return to regular to at 8:35 PM, second by Councilmember Roark.

Councilmember Roark made a motion to approve Richard P. James Esq. to sign the stipulated order of assessment Index #96514, second by Councilmember Barrows. So carried.

Councilmember Lawson made a motion to adjourn at 8:50 PM, second by Councilmember Lawson.
